Helmet scam

So,

I am currently in a dispute with a helmet retailer over the helmet I was sold to participate in MSA Karting events.

I am new to karting and the retailer, who shall remain nameless for the moment, sold me a 2009 MSA approved helmet which is being “phased out” this year.

The Helmet in question is an AGV Stealth BSI Type A (Blue sticker)

My concern is that the retailer sold me a helmet, that was specifically advertised as suitable for karting, but made no effort whatsoever to inform me that it would not be suitable after January 1 2010

The retailer informs me that they were only made aware of the regulation change a couple of months ago and have since removed the listing from their website.

This leaves me £180 out of pocket because the retailer claims I am not entitled to a refund because he was not aware of the regulation change at the time of sale and advertised it as an MSA 2009 approved helmet.

Rather unscrupulous to say the least.

I was new to karting when I bought the helmet and admit, rather rushed into things, so I went for the first retailer who gauranteed me that a certain helmet would be eligible to race in MSA racing.

How long has this reg change been public knowledge? Is it likely that a major helmet retailer could not have known about the impending change in the last year?

Would it have been reasonable for him to state on his website that the rules were subject to a pending change - even if nothing had been firmed up??!

He claims nothing was firmed up until a couple of months ago and as such had no duty to say otherwise. Is this the case?

I've told him I dont even want a refund, the helmet is in as-new condition with original packaging, but just want a suitable replacement to the same value. I would even pay more to make it up.
