The courts have been trying for YEARS to be able to show 'inention' and most lawyesr will agree, it's just about IMPOSSIBLE to show 'intent' in this sort of case.

That's why the implementaion of the rules should be simple.

First: restate the key rule..... 'the ONLY parts of the track where you may race are WITHIN the white lines: kerbs are OUTSIDE the white lines.

Then, the only 'tests' should be....

1) Did any part of the kart leave the borders of the track (even a single wheel ouside the white line)?

2) Did the kart N*O*T LOSE OUT by leaving the track? If the driver did NOT go slower because of leaving the track, then he should be penalised!

A driver who spun onto the grass would then not be penalised as he will have gone slower. A driver who hits the kerb by mistake and is thrown wide by that 'collision' would NOT be penalised. And so on...

BUT....

...a driver who either goes FASTER or remains JUST as fast when hitting kerbs M*U*S*T be penalised!

That way, you don't need to show 'intention' or anything else! Kerb hiting should ALWAYS result in getting a WORSE lap time... even if the extra time is because the CoC penalises you for hitting the kerb!

Enforcing the rules is the ONLY way!
