I think you are confused, the current regulation J5.20.5 is practically the same as the new proposed J.5.21.1, both say you need the Chief Scrutineer and Event Organiser permission. It has to be left to organisers as there may be media rights in place or other reasons not to have a free for all. I think the proposed regulations are just giving guidance on fitting and use for judicial purposes.
