The rules are different for the old clutch, this debate is about the new one.

The reason for the difference is that for the new clutch only JAG have said the presence of oil or grease on the clutch components is not in itself a reason for technical exclusion, they have not said that for the old clutch. Yes you could argue that it should be the same for the old design but JAG have NOT said that.

ps. I take your point on the slipper clutch but you understand what I mean. If its electronics or the clutch is BIG money and as I am sure you know bikes when braking hard tend to lift the rear wheel off the ground all together!
