Your argument is fallacious. I'll show you where:-

1) our society is run under a (supposed) principle of law enforced by the Police and the Justice system.

2) Without the threat of 'punishment' for breaking the law, there would be a greater number of illegal acts than there are today. There are LOADS of people, like me, who do not want to be punished for breaking a law even if we DON'T agree with that law. The threat of PUNISHMENT (not the fear of being 'caught WITHOUT a punishment) keeps many of us 'in-line'. In précis:- Punishment WORKS in deterring many crimes.

3) Would ANYONE claim that the Police and the Justice system NEVER convicts an INNOCENT person......???????? (that's rhetorical.... no one is stupid enough to claim that!)

So, assuming we agree with the above, you accept that, even though the justice system gets things WRONG (on too many occasions) it still has a damned good effect on society. The system isn't perfect but it's better than NO such system, even allowing for the errors in it.

So....

4) For you to remain consistent with your views of karter-punishment, you MUST be implying that, BECAUSE we can't guarantee 100% perfect conviction rate, we should NOT have our current justice system. Are you SURE about that?????

Please explain to me why a methodology that works with a TOLERABLE reliability (our justice system)should NOT have the same effect on karters that it has on the REST of society. To précis that: why is it that a flawed system that has good effects MOST of the time works for a justice system will NOT 'work' for karters?

Henning Wehn expressed that real situation with stunning German efficiency last week....:-

" Punish one..... and you'll teach a thousand!"

Now....... who is more unfairly punished? A kid who is wrongly black-flagged (3 races in a row) or the bloke who gets sent to jail for 27 years for a crime which the Police KNEW that he could not have committed (Stefan Klitchko)????? (again, that's rhetorical). Doesn't your view suggest that we must ABANDON our present justice system BECAUSE it manages total DISASTERS in some cases even though it has a good effect in the VAST MAJORITY of cases?

But.... YOU are claiming that potential chances of 'faulty black-flagging' invalidates the use of a punishment system BECAUSE it will be wrongly applied in SOME cases.... If that is your view..... we don't agree!

I would argue that such black-flag punishments WOULD improve the standard of driving EVEN THOUGH sometimes, it would be wrongly applied. How do I come to that opinion? I saw it WORK for the first 20 years of my kart-racing. Behaviour was BETTER when Reg Deavin was 'in charge' (at Rye) than it was after he stopped. 'Little Tony' at Kimbolton was a TOTAL PAIN IN THE A**E and I was black flagged more than once unfairly...... BUT under both of those guys: racing WAS fairer than it is today and we had a darned sight less ramming because we knew 'the sword of Damoclese ' hung over our heads!!

Please show me the faults in my logic with the above.
