If you have less than 1ltr in your tank at the end of the race and it is spotted then you should be excluded.
If the srutineer wants to take a fuel sample then under the rules this is taken in 1ltr amounts. If you want to retain a sample (sealed) then you have to have 3ltr in the tank. If you have less than 3ltr then you forfeit your right to retain a sample.

Blue book - page 80 exokains the procedure.
