The teams are allowed to change 7th gear. What they can't do is change it (or any others) between qualifying and the race, hence cars expected to be running in clean air start hitting the limiter when running in traffic.

Also, upshifts have to be wholly driver controlled, they cannot preselect gears. For what you are describing to occur, the driver would have to shift through sixth to seventh and back again. Finally, it is often impossible to assemble a gearbox with ratios swapped round in such a fashion although that, admittedly, depends on the specific design of the box.
