Well he seems pretty confident with the evidence he says they have. Let's not forget this is the guy who ran the team with a rule bending double diffuser that had a massive advantage during JB's championship winning year.

Ross is worried though... it's an independent court.

This is how I think it will pan out:

The Mercedes, Pirelli and the FIA will all say they didn't break any rules. They will lay down all the evidence with the correspondence to and fro the FIA. It 'WILL' show that the FIA gave the go ahead. But the court will rule that the FIA was wrong in giving the go ahead without a change in the rules.

They will say that Mercedes broke the rules, even though they asked the FIA if it was ok, it is irrelevant as they broke the actual rules. For it to be ok the rules should have been changed and re-written, that's what they are there for.

They will say that the FIA were irresponsible to give the go ahead, and give them a slap on the wrist.

They will say that Pirelli broke the rules for using a current car in the test.

They will rule Pirelli and Mercedes as having broke the rules. They will rule the FIA as being irresponsible. What the penalties will be will be written in the rules.
