Have these tyres been used?
If so.... if I was the supplier, I'd immediately wonder if they had been 'run' while at a very low pressure (if defalting slightly). This would stress the side walls and could easily make them porous after use having NOT been porous BEFORE use......!
If they haven't been used, then that suggestion won't 'hold up'. However, if they have been, I suggest you try to think of a 'evidence' that would REFUTE my suggestion.
Like every other component, tyres MIGHT be faulty: to get your money back, I would suspect that you'd have to PROVE they were faulty before you used them..... and that's not so easy.
