There's a difference between a web domain being available, a company name being available and infringing on someone's trademark.

If you are operating within a broadly similar industry and have a name that is too close, or a logo etc that is too similar, you could be guilty of infringing someone's registered trademark. If you haven't registered your trademark, you have little room for complaint.

In principal, it's all really simple stuff, but in practice the lawyers make it complicated and expensive.
