Rubbish.

The blue book expressly says (U 12.5.4)
"Where a driver consistently drives with a wheel off the track or leaves the track this may be deemed driving in a manner incompatible with general safety and the Driver may be excluded from the race at the discretion of the CoC"

So, one wheel regulary on the kerb and you can be excluded. The old rule said 'twice' which isn't the same thing as consistently and I guess could lead to frivolous complaints. Consistently implies that it is done with forethought to gain an advantage or that the driver is not in control. The former is cheating and the latter inconsistent with general safety. Hence the CoC can use discretion.

I suspect that you are getting confused by the circuit racing regulation (O 14.5 b) that clarifies 'leaving the track' as being no part of the car remains in contact with the track.

Quite honestly, you can understand the MSA ignoring petitions when the petition has a solution already in the Blue Book.
