No, I don't see it as unfair. Your older TKM chassis is still made uncompetitive by people having the option of welding in (or not) a torsion bar. Further, I doubt any of the older TKM chassis were designed for the new chassis. Finally, while older chassis can still be used, a new chassis will generally be quicker (not new design, new as in less used) and the older type TKM chassis are no longer really available.
If you insist on running older equipment and maintaining its competitiveness, the class will only go backwards. The benefit of allowing the CIK style chassis has been negated by the rules imposed to achieve this.
