I'm not sure that the full transcript gives us any further insight into the ruling. Either Ferrari contravened the regulation and should have been penalized at the highest level or they didn't... in which case they should not be penalized at all.
Note if the regulation was ambiguous or flawed in any way, then you can't determine whether or not it was broken and you would need to default to dismissal of this AND any prior cases involving that rule !
It seems that the FIA are saying that the rule was flawed but they're upholding the penalty issued by the race stewards in Germany on the day. Utterly bizarre.
