I know of a view taken on this by a former Scruitineer which I liked and thought was fair.
If the meeting is declared open, then the Blue book doesn't state a minimum tread depth, so as long as there was some tread and he deemed it safe all was well and good.
If however the meeting was declared wet, or there was standing water, as in it start to cover as oppose to just dampening the surface, then the minimum tread depth applied.
His view was as we don't have intermediates, then worn wets were the only option and it saved money.
