The copyright laws are fraught with grey areas. I do paintings of race cars as a hobby and have even been commissioned by F1 drivers/teams in the past. I have always gone from a photo and the photographer always holds the copyright. I was rather amazed when I was told that even a painting done from the photo is a breach of copyright so I just change enough things to make it a bit different. I think it very doubtful that someone would take the trouble to go to litigation for something so trivial..and if they did, it would probably be laughed at by the courts unless you were taking a commercial (money) advantage.
